You can be sued for everything. Look at the stupid warnings on products today. Brakes hell, if someone in your house and down the stairs, you can sue. The possibility that Sue and if they lose the application is virtually non-existent though.
Write to abandon an "AS IS", all items are sold "seller does not" disclaimer. You can still sue, but it makes it very, very difficult.
